1. Introduction
1.1. These Aspire Cashback Terms (“Cashback Terms'') govern your participation in the Cashback Program and describe how you may qualify for, earn, redeem, retain, and/or forfeit Cashback. These Reward Terms are supplemental to and form part of the Master Service Agreement (“Agreement”) and the Product Schedules.
1.2. Please read these Reward Terms carefully together with the Agreement and the other Product Schedules (as applicable). Capitalised terms that are not defined in these Cashback Terms shall have the same meaning assigned to them in the Agreement or the other Product Schedules (as applicable).
1.3. By retaining or using an Aspire Card, you are automatically enrolled in the Cashback Program. In the event of any conflict relating to the Cashback Program between these Cashback Terms and any other terms, agreements, or policies set forth in the Agreement, Product Schedules, or promotion terms and conditions, these Cashback Terms shall govern.
1.4. Aspire may update these Cashback Terms with or without notice to you by posting an updated version of these Cashback Terms at any time. Cashback is subject to changes, including elimination, at any time. Continued participation in the Cashback Program, which is reflected by continued use of the Aspire Card and Aspire Account, after any change, constitutes your agreement to be bound by any such changes.
1.5. You may participate in the Cashback Program only if you accept all of these Cashback Terms. If you no longer wish to participate in the Cashback Program, you may close your Aspire Account or contact Aspire at support@aspireapp.com to request to be removed from the Cashback Program.
2. Eligibility Criteria
2.1. To be eligible for the Cashback Program, your Aspire Account and Aspire Card must be open and in good standing. If your Aspire Account is not in good standing for any reason, or we determine in our sole discretion that you are abusing or misusing the Cashback Program or have otherwise violated the Agreement, other Product Schedules, or any of the terms, agreements, and policies of Aspire, you will no longer be eligible for the Cashback Program. We may condition, restrict, limit, revoke, or clawback Cashback in our sole discretion.
2.2. The Cashback Program allows you to accrue Cashback when you make a Qualifying Spend (as defined in Clause 2.3) on a card. For each Qualifying Spend you make, you accrue cashback rewards at a rate of 1.2% (“Cashback”). Cashback may only be available in connection with Aspire Card purchases and not any other product or service offered by Aspire.
2.3. “Qualifying Spend” means all settled transactions on Aspire Cards, excluding ineligible transactions.
2.4. Ineligible transactions include:
(a) Government services and Tax;
(b) Bill payments (Insurance, Utilities and Telecom);
(c) Groceries, Specialty Retail, Clothing & Apparel, and Home Furnishings;
(d) Fuel & Gas;
(e) Real Estate and Property Management;
(f) Local Transport, Parking & Freight;
(g) Prepaid Instruments & Cash Equivalents;
(h) Education;
(i) Non-Profit & Organizations;
(j) Gambling & Lottery;
(k) Fast food; and
(l) Movie Theatre and Ticketing.
2.5. Notwithstanding the above, Aspire may determine that a transaction type, or a particular transaction, is excluded from eligibility for earning Cashback in its sole discretion at any time.
2.6. For any transaction that does not qualify as a Qualifying Spend but for which you have already received Cashback, or if we otherwise awarded you Cashback in error, we may clawback such Cashback using your remaining or future Cashback balance.
3. Cashback Received
3.1. You are responsible for making sure the Cashback reflected in your Aspire Account is correct. If you believe that your Cashback is not reflected accurately, please contact Aspire’s customer support team at support@aspireapp.com. You must notify us of any errors or discrepancies within 60 days of such information being made available to you, i.e., reflected on your Aspire Account balance. If you do not notify us of any such errors within 60 days, you forfeit the right to contest your Cashback earned, except to the extent such forfeiture is prohibited by applicable law.
3.2. If you voluntarily close your Aspire Account or your Aspire Card, you will no longer be able to earn any Cashback on any transactions. If your Aspire Account is suspended or closed for any reason, you will not earn any Cashback until your Aspire Account is restored to good standing under the Agreement and these Reward Terms. If your Aspire Account is suspended and reopened after such suspension is cleared, you will continue earning Cashback, and you will be entitled to previously accrued Cashback.
3.3. Cashback are not transferable to any third party or any other Aspire Account, including any other Aspire customer, and cannot be transferred by operation of law.
4. Crediting of Cashback
4.1. Any Cashback will be credited in HKD regardless of the Qualifying Spend currency. For the avoidance of doubt, where the Qualifying Spend is in currencies other than HKD, Cashback will be calculated and/or converted at the prevailing exchange rate on the date of the transaction.
4.2. Your Cashback earned from Qualifying Spend will typically be credited in one lump sum, within the 6th business day of the month, for completed card spend during the preceding month. For example, Cashback earned in February will typically be credited in one payment in the first week of March.
4.3. All Cashback payments will be credited to your Aspire Account.
4.4. Cashback may be reversed or deducted from your Aspire account balance in the subsequent cycle if any Qualifying Spend (in full or in part) are subsequently cancelled, suspended, frozen or refunded.
5. Taxes
Aspire understands that the Cashback may qualify as taxable income for you. You are solely responsible for determining and obtaining appropriate tax treatment for any Cashback you receive. You are solely responsible for any tax liability arising from or related to any earned Cashback. Aspire will not report any income or earnings related to the Cashback to a taxing authority, except where expressly required by law.
6. Losing Cashback
6.1. If your Aspire Account is voluntarily closed and your Cashback has not been provided to your account yet, you will lose any remaining Cashback.
6.2. If your Aspire Account is suspended or closed for any other reason, your Cashback may be lost or forfeited, subject to Aspire’s sole discretion.
6.3. You may be disqualified from participating in the Cashback Program if at any time:
(a) you have been deemed in Aspire’s discretion to abuse the Cashback Program or breach any other agreements with Aspire;
(b) we have reasonable grounds to believe that you or an Authorised User(s) on your account have engaged in any fraud or material abuse of this Program;
(c) you engage in self-dealing; or
(d) you attempt to or otherwise game or misuse the Cashback Program.
6.4. Where we determine, in our sole discretion, that you or any Authorised Users no longer satisfy the requirements for participation in the Cashback Program, we may disqualify you from the Cashback Program, and you may lose or forfeit any Cashback that you may have earned.
6.5. We may reinstate any lost or forfeited Cashback in our sole discretion, and we may require a fee or other conditions to do so.
7. Miscellaneous
7.1. Aspire may terminate the Cashback Program at any time. If the Agreement is terminated, these Cashback Terms will also immediately terminate.
7.2. To the maximum extent permitted by law, you agree to release Aspire from all liability for your participation in the Cashback Program. You further agree to release Aspire from liability for third-party claims in accordance with these Cashback Terms.
7.3. If any provision of these Cashback Terms is found to be invalid, unlawful, void, or unenforceable, the Cashback Terms’ remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions of these Cashback Terms shall remain in full force and effect.
7.4. You agree that if Aspire does not enforce any of its legal rights or remedies under these Cashback Terms, or any other legal rights or remedies Aspire has under applicable laws, it shall not be construed as a waiver of those rights or remedies or any other rights in any way whatsoever.
7.5. These Cashback Terms will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Cashback Terms. You may not assign or transfer these Cashback Terms or your rights hereunder, in whole or in part, by operation of law or otherwise, without our prior written consent. We may assign these Cashback Terms or any of our rights or obligations under these Cashback Terms at any time without notice.
7.6. You understand and agree that these Cashback Terms are solely between you and Aspire and that the Cashback Program is offered and administered by Aspire and not any other third party, including the issuing bank of the Aspire Card. You understand and agree that any and all disputes related to the Cashback Program or any Losses associated with your participation in the Cashback Program are to be resolved between you and Aspire, and not the issuing bank of the Aspire Card.
7.7. These Reward Terms are governed by and construed in accordance with Hong Kong law.
8. Definitions
In these Cashback Terms:
8.1. “Agreement” has the meaning ascribed to it in Clause 1.1.
8.2. “Cashback” has the meaning ascribed to it in Clause 2.2.
8.3. “CashbackProgram” means the program made available by Aspire to you under these Cashback Terms.
8.4. “Cashback Terms” has the meaning ascribed to it in Clause 1.1.
8.5. “Qualifying Spend” has the meaning ascribed to it in Clause 2.3.
