Information on Right to Cancel

Effective from

This Notice on your Right to Cancel (“Notice”) is issued pursuant to the “SFA 04/13-N01 – Notice On Cancellation Period For Units In Authorised Collective Investment Schemes” by the Monetary Authority of Singapore (“MAS”).

Defined terms which are not defined in this Notice have the same meaning as set out in the Yield Services Agreement. 

1. The Right to Cancel

This Notice only applies to you if you are a sole proprietor that has invested in a Fund that is an Authorised CIS. In this Notice, “Authorised CIS” means a collective investment scheme under which the property is held on trust for the participants as defined under section 2 of the Securities and Futures Act of Singapore (SFA), and is authorised under section 286 of the SFA.

2. The Cancellation Period‍

‍If you have the right to cancel, you are allowed to cancel your Buy Order within 7 calendar days (the “Cancellation Period”) by submitting your cancellation request via the Platform or such other methods as may be accepted by us from time to time. Any cancellation request must be for the full amount of the Buy Order and will be irrevocable upon submission.

Where the last day of the Cancellation Period falls on a Sunday or a public holiday, the Cancellation Period shall be extended to the next calendar day, not being a Sunday or a public holiday.

3. When the Right to Cancel Does Not Arise

Notwithstanding this Notice, you do not have the right to cancel in the following circumstances:

  1. you are not a sole proprietor; or
  2. you are a sole proprietor but you are an existing investor in the Authorised CIS, and the Buy Order (that you wish to cancel) is your second or any subsequent purchase order for units in the Authorised CIS, unless such Buy Order was entered into by you within the Cancellation Period of your first purchase order in respect of the Authorised CIS.

4. How to Exercise Your Right to Cancel

You may exercise your right to cancel by submitting your cancellation request with the subject title “Exercising Right to Cancel Trade” to us at support@aspireapp.com using your Aspire registered email address and providing the following details:

  1. Account Number:
  2. Full Name of Account Holder(s):
  3. Authorised CIS Name (including Share Class):
  4. Currency of Authorised CIS:
  5. Investment Amount (Please note that cancellation is limited to Full Redemption Only):
  6. Date of Subscription:
    (the “Cancellation Form”).

5. Calculation of Amount To Be Repaid

In calculating the amount to be refunded, the relevant price for calculating the said amount will be the Net Asset Value per Unit following our receipt of the Cancellation Form, subject to requirements under the prevailing Code of Collective Investment Schemes and any other regulations or exemptions that apply to the Fund and/or Fund Manager, and less any reasonable administrative expenses incurred by us in processing your cancellation order.

6. Implications of Cancellation

Where the market value of the Units as of the date of submission of the Cancellation Form is greater than the original amount paid by you, we and/or the Fund Manager are not obliged to pay the excess amount to you. Where the market value of the Units held by you is lower than the original amount of investment, you will only receive the market value of the Units and will not be entitled to recover the original amount of investment. You accept that you will alone have to bear the losses from the actual amount of investment in this regard. 

We and/or the Fund Manager shall be entitled to recover any expenses which are reasonably related to the Buy Order and subsequent cancellation request, which we have incurred by deducting the same from the cancellation proceeds to be repaid to you. However, any sales charge, front-end load fee or realisation charge for redemption of the Units will not be chargeable to you. The amount to be refunded to you will be subject to the Fund Manager’s confirmation.

7. Implications of Redemption 

During the Cancellation Period, you may choose to redeem your Units instead of exercising your right to cancel. You acknowledge that:- (a) the published prices may change during the period between the submission and processing of the redemption request; and (b) you may not be able to enjoy the benefits of cancellation (i.e., refund of any sales charge applied) in the event that you choose to redeem your Units instead of cancelling the Units and that the redemption proceeds that you will receive may be lower than the amount being refunded had you exercised your cancellation right if the appreciation in the value of Units  is less than the initial sales charge.
