Electronic Communications Policy

This policy describes how Aspire delivers communications to you electronically. We reference certain terms in this Electronic Communications Policy that are defined in the Service Agreement. We may amend this policy at any time by posting a revised version on our Website. The revised version will be effective at the time we post it.

1. Electronic delivery of communications

You agree and confirm your consent to (a) receive electronically all communications, agreements, documents, notices and disclosures (collectively, “Communications”) that we provide in connection with your Aspire Account and your use of our Services; and (b) the use of electronic signatures. Communications include:

  • agreements and policies you agree to in connection with Aspire Services, including updates to such agreements or policies;
  • transaction receipts or confirmations;
  • any disclosure statement governing your use of the Services;
  • account statements and history; 
  • tax statements we may be required to make available to you, if any; 
  • any other Aspire Account or transaction information; and
  • any disclosure required by Law.

We will provide these Communications to you by posting them on the Platform website and/or by emailing them to you at the primary email address listed in your Aspire Account profile.

2. Electronic signatures 

Aspire may execute Communications electronically. If Aspire requests, you will execute Communications electronically. You also agree that Communications you or Aspire signed electronically will have the same legal effect as a signed physical document.

You acknowledge and agree that if you reside in the United States, the Services are subject to the federal Electronic Signatures in Global and National Commerce Act ("E-SIGN Act"), and that you intend that the E-SIGN Act apply to validate your ability to engage in transactions related to theServices electronically.

3. Hardware and software requirements

In order to access, view, sign and retain electronic Communications that Aspire provides to you, you must have:

  • A computer or mobile device with an Internet connection with a current web browser that is capable of receiving, accessing, displaying and either printing or storing communications received from us in electronic form;
  • A valid email address (your email address that you have on file with Aspire);
  • Adobe Acrobat Reader version 8.0 and above to open documents in .pdf format;
  • A current web browser that includes 128-bit encryption (e.g. Internet Explorer version 6.0 and above, Firefox version 2.0 and above, Chrome version 3.0 and above, or Safari 3.0 and above) with cookies enabled;
  • Sufficient storage space to save past communications and/or to print them.

We will notify you if there are any material changes to the hardware or software needed to receive electronic Communications from Aspire. By giving your consent you are confirming that you have access to the necessary equipment and are able to receive, open, and print or download a copy of any Communications for your records. You may print or save a copy of these Communications for your records as they may not be accessible online at a later date.

4. How to withdraw your consent

You may withdraw your consent to receive Communications electronically, or consent to electronic signatures, by contacting us at: support@aspireapp.com.

If you fail to provide or if you withdraw your consent to receive Communications electronically, Aspire reserves the right to either deny your request for an Aspire Account, restrict or deactivate your Aspire Account, close your Aspire Account, or charge you additional fees for paper copies.

5. Requesting paper copies of electronic communications

If, after you consent to receive Communications electronically, you would like a paper copy of a Communication we previously sent you, you may request a copy within 180 days of the date we provided the Communication to you by contacting us as described above. We will send your paper copy to you by U.S. mail. In order for us to send you paper copies, you must have a current street address on file in your Aspire profile. If you request paper copies, you understand and agree that Aspire may charge you a fee for each Communication.

6. Updating your contact information

It is your responsibility to keep your primary email address up to date so that Aspire can communicate with you electronically. You understand and agree that if Aspire sends you an electronic Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, Aspire will be deemed to have provided the Communication to you.

Please note that if you use a spam filter that blocks or re-routes emails from senders not listed in your email address book, you must add Aspire to your email address book so that you will be able to receive the Communications we send to you.

You can update your primary email address or street address at any time by logging into the Platform, going to “My Account”, and selecting the “Profile” tab. If your email address becomes invalid such that electronic Communications sent to you by Aspire are returned, Aspire may deem your Aspire Account to be inactive, and you will not be able to transact any activity using your Aspire Account until we receive a valid, working primary email address from you.
